Okay, not as in the baseball kind of out but as in the lawsuit got tossed without the ability to refile their respective claims… which just goes to show that Apple is not always capable of warping reality towards their favor. Moreover, with Google now Motorola’s parent company this has clearly got to upset the brass in Cupertino!

A class-action lawsuit has been filed against LinkedIn (due to their recent password security breech) which begs the question: does this bring new meaning to the word frivolous and/or does said filing actually have merit?

And, they’re off… Okay, actually Redmond’s latest OS isn’t quite off yet (it is slated for release this fall). Nevertheless, given the challenges that Microsoft is / has been / continues facing the pressure is on them (and Nokia; PC makers… add Tablets too for that matter).

Facebook offered a rare glimpse into how the firm polices content – which is a good thing (service). Conversely, for investors who felt burned by their IPO (aside from institutional ones of course) they in all probability would’ve been much more satisfied with finding out just how overrated their valuation actually was… but that’s another issue entirely…

Although the upper-echelons of the firm will receive most of the news regarding their (pending) departure(s)… the first of (what will in all probability be) many layers of management at Facebook has publicly reported their resignation as the company undergoes the next phase of their maturation process (which post their IPO has been anything but smooth…)

With Nokia’s on-going legacy-woes (prior to essentially placing their future on a bet with Microsoft and their unproven mobile phone OS) the firm looks to be in an almost unescapable death spiral (which is never a good thing regarding those that lose their jobs, etc.) due to a combination of hubris; insularity; a (corporate) solo mentality and basically getting caught flat-footed regarding the Smartphone Revolution (akin to the PC Revolution and the fallout of many typewriter firms that went by the wayside… remember Singer as but one example?) In sum, their situation is looking anything but almost terminal (at this juncture).
